How to File Patent – US Provisional Application

Step 1: Complete a draft of your patent application or a record/document of your invention, including written description having sections entitled: Name, Address, Citizenship, Title, Technical Field, Background, Brief Summary, Description of Drawings, Detailed Description, Claims, and Abstract; and drawings. Seek the advice of a Patent Attorney in preparing your US Provisional Patent Application.

Step 2: Prepare a US Provisional Application Cover Sheet. You can locate the USPTO form PTO/SB/16  or search USPTO for keyword ‘forms’.

Step 3: Prepare a US Provisional Application Fee Transmittal. You can locate the USPTO form PTO/SB/17 or search USPTO for keyword ‘forms’.

Step 4: Prepare a US Provisional Application Cover Letter and Post Card along with the documents in the steps above to be Express mailed to the US Patent & Trademark Office. Prepare the Express mail label from the US Postal Service and mail all the above documents to:

Step 5: Have a Patent Attorney review your entire Provisional Patent Application before you file any documents with the US Patent Office. This document was prepared late 2009 and the rules and procedures change frequently at the US Patent Office.
